1. Third Party Observations under article 115 of EPC

TKDL third party submission under Article 115 EPC brought to the notice of examination division the prior art references on the use of Allium cepa (onion) and Cocos nucifera (coconut palm) for the treatment of Worm infestation, Intestinal Worms/Helminthiasis, Thread worm and used as as Anthelminthic and Expulsive of Tape Worm from the books – Aavialikkum Amuthamurai Churukkam (Athmarakshaamirtha Vaithiya saarasangiraham) by Kandasamy Mudaliar (Siddha, Exhibit 1), Kitaab-al-'Umdah-fil-Jeraahat, Part I by Aminuddaulah Abul Farj Ibn Al-Quff Maseehi (Unani, Exhibit 2), Kitaab-al-Haawi-fil-Tibb, Vol.XI by Abu Bakr Mohammad.Bin Zakariyya Al-Razi (Unani, Exhibit 3), Brhat Nighantau Ratnakara (Saligramanighantubhusanam) (Ayurveda, Exhibit 4), Khazaain-al-Advia, Vol II by Mohammad Najmul Ghani Khan (Unani, Exhibit 5), Rasatantrasarah Evam Siddhaprayogasamgrahah;- part 1(Ayurveda, Exhibit 6), Qaraabaadeen Najm-al-Ghani by Mohammad Najmul Ghani Khan (Unani, Exhibit 7) and Agathiyar Vaithyam- 600 by Agasthiyar (Siddha, Exhibit 8).

EPO Patent Examiner(s) took cognizance of TKDL references. Extract of examination report at Para 6 are reproduced below.

“Finally, third party observations in the sense of Article 115 EPC have been filed. It appears that the document “Exhibit 1 “ discloses a composition comprising coconut and onion for oral administration for treating parasitic worms. Thus, it appears that the present subject matter lacks novelty over this reference, (Article 54(2) EPC).”
